1) Acceptance of Terms

By accessing xplosivehq.com, booking a consultation, or training with Xplosive HQ, you agree to these Terms, our Privacy Policy, and any service-specific rules posted on our site or in-studio.

2) Eligibility

You must be 13+ to use the site and 18+ to purchase services (or have parent/guardian consent for minors). We may verify identity and refuse service at our discretion.

3) Services & Bookings

• Consultation required: All new clients start with a paid 30-minute intake.

• Scheduling: Sessions occur at the time slots assigned after your consult.

• Coach-led training: 1-on-1, Partner, Semi-Private (2–4), and Small Group (2–5).

• On-Demand/Recovery access (e.g., Peloton, FightCamp, Yoga/Meditation, Normatec) is in-studio only during non-coached hours by reservation.

4) Billing & Payment

• Biweekly billing based on your plan (e.g., 2×/week or 3×/week).

• Payments are processed by third-party providers (e.g., Wix Payments/Square).

• You authorize automatic charges each billing cycle until canceled per these Terms.

• Failed payments must be resolved within 48 hours to keep your spot.

5) Cancellations, No-Shows, & Make-Ups

• Consultation: Non-refundable if canceled within 24 hours of start time.

• Training sessions: Cancel 24+ hours before start to be eligible for a make-up (subject to availability; not guaranteed).

• Late cancel / no-show: Counted as a used session.

• Make-ups expire at the end of your current billing period unless otherwise stated.

6) Freezes & Plan Changes

• One freeze per quarter (up to 2 weeks) with written notice before your next bill date; pro-rates/credits applied to the next cycle where applicable.

• Plan downgrades or upgrades may affect schedule availability and pricing.

7) Refunds & Credits

• Services already rendered are non-refundable.

• Prepaid sessions are refundable only as stated in our Refund Policy.

• Billing errors: contact us within 7 days for review.

8) Studio Conduct & Safety

Respect the space, coach instructions, and fellow athletes. No harassment, discrimination, or unsafe behavior. Phones away during sets unless tracking training data. We may remove anyone violating conduct rules without refund.

9) Health; Assumption of Risk; Release

Physical training involves inherent risks. By participating, you confirm you’re medically cleared and you assume all risks associated with exercise, equipment, and facilities. To the fullest extent permitted by law, you release and hold harmless Xplosive HQ, its owners, employees, and contractors from claims arising from participation, except where caused by our gross negligence or willful misconduct.

10) Not Medical Advice

Content on our site, socials, or in-studio is educational only and not medical or nutrition advice. Consult a qualified professional for medical concerns.

11) Minors

Parent/guardian must consent for participants under 18, complete all intake forms, and accept these Terms on the minor’s behalf.

12) Website Use & IP

All content on xplosivehq.com (logos, text, images, videos) is owned by or licensed to Xplosive HQ and protected by IP laws. You may not copy, distribute, or exploit content without written permission.

13) User Content & Testimonials

If you submit feedback, reviews, images, or testimonials, you grant Xplosive HQ a non-exclusive, royalty-free license to use and display them for marketing, in accordance with our Privacy Policy. Request removal at any time via email.

14) Third-Party Services

We use third-party tools (e.g., bookings, analytics, payments, embedded media). Their terms and privacy practices apply in addition to ours. We’re not responsible for third-party outages or changes.

15) Communications Consent

By providing your email/phone, you consent to receive transactional messages (booking reminders, receipts) and optional marketing messages (opt-out anytime). Standard carrier rates may apply.

16) Privacy

Our Privacy Policy explains what we collect and how we use it. By using our services, you consent to those practices.

17) Changes to Services or Schedule

We may modify class times, coaches, session formats, or features. We’ll attempt reasonable notice for material changes affecting active clients.

18) Force Majeure

We aren’t liable for delays or failures caused by events beyond our control (e.g., severe weather, power loss, illness, government actions).

19) Disclaimers; Limitation of Liability

Services are provided “as is” to the extent permitted by law. Xplosive HQ’s total liability for claims related to the services is limited to the amount you paid in the last 3 months preceding the claim.

20) Indemnification

You agree to indemnify and hold Xplosive HQ harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or misuse of the services.

21) Governing Law; Venue

These Terms are governed by the laws of the State of Georgia. Courts located in Liberty County, GA (or the nearest appropriate Georgia venue) have exclusive jurisdiction.

22) Dispute Resolution (Informal First)

Before filing a claim, contact us to try to resolve the issue within 30 days. If unresolved, you may pursue remedies in the courts above. (Nothing here prevents small-claims actions where allowed.)

23) Changes to These Terms

We may update these Terms at any time. The “Last updated” date reflects the current version. Continued use after changes means you accept the revised Terms.
